Terms and Conditions - Algarve Sensations

By accessing or using the website www.algarvesensations.com or making a reservation for any tours or experiences, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. General Provisions
1.1. These Terms and Conditions govern access to and use of the website www.algarvesensations.com, owned and operated by Algarve Sensations, SEBASTIÃO GONÇALVES DE ASSUNÇÃO, NIF 208553819, URB TAVIRA GARDEN BLOCO 23 - 2º - ESQº 8800-221 TAVIRA and the booking of tours, experiences or services provided by Algarve Sensations or its third-party partners.

1.2. Algarve Sensations is a registered operator under Portuguese law RNAAT 558/2020, offering guided tours and experiences in the Algarve region. Some services are purchased through third-party partners, including those booked on platforms such as Bokun or others.

1.3. By accessing the website or booking a service, you accept these Terms and Conditions in full. If you do not agree, you should not use the website or book any services.

2. Bookings and Payments
2.1. All bookings are subject to availability and confirmation by Algarve Sensations or its third-party partners.

2.2. Bookings made through the website or third-party platforms such as Bokun require full payment or a deposit, as specified at the time of booking.

2.3. Prices are final and quoted in Euros (€). Algarve Sensations reserves the right to modify prices on the website and its partners without prior notice due to changes in costs or taxes. This does not affect services purchased before such price changes.

2.4. Payments are securely processed through third-party payment processors. Algarve Sensations is not responsible for problems arising from errors in payment processing by third parties.

2.5. The person making the reservation is responsible for ensuring that all members of the group are aware of and agree to these Terms and Conditions.

3. Cancellations and Refunds
3.1. Cancellations by the client are subject to the following penalties:
Up to 24 hours before the activity: Full refund.
Less than 24 hours or no-show: 100% penalty (no refund).

3.2. Algarve Sensations reserves the right to cancel or reschedule activities due to weather conditions, insufficient number of participants, or unforeseen circumstances. In such cases, clients will be offered an alternative date or a full refund. 3.3. Refunds, where applicable, will be processed according to the refund policy of the third-party payment platform used, according to the original payment method. 3.4. For bookings made through third-party platforms such as Bokun, the platform's cancellation policies may apply in addition to these terms.

4. Tour and Experience Conditions
4.1. All participants must arrive at the specified departure point for each tour 10 minutes prior to departure and comply with the safety instructions provided by the guides or staff. Failure to comply may result in removal from the activity without refund.

4.2. Some activities may have specific health, fitness or age requirements. Clients are responsible for ensuring they meet these requirements and informing Algarve Sensations of any relevant conditions (e.g., medical issues, pregnancy or children under 13) at the time of booking.

4.3. Activities such as cave visits or water excursions are subject to favorable weather and sea conditions. Algarve Sensations is not responsible for cancellations or changes due to unsafe conditions, and no refunds will be made in these cases, except where specified.

4.4. Children under 16 years of age must be accompanied by a responsible adult.

4.5. Algarve Sensations is not responsible for personal belongings lost or damaged during activities. Customers are advised to store their belongings properly. Travel baggage with travel volume is not permitted.

5. Insurance
5.1. All tours and experiences are covered by mandatory civil liability insurance and other personal injury insurance, as required by Portuguese law.

5.2. Clients are responsible for their own travel, medical or cancellation insurance. Algarve Sensations does not offer coverage for personal injury, damage or loss, except if caused by gross negligence.

5.3. For activities operated by third parties, insurance is provided by the respective partner, and their terms apply.

6. Privacy and Data Protection
6.1. The personal information collected during bookings will be used exclusively for the provision of the requested services and will not be shared with third parties, except when necessary for the provision of the service (e.g., third-party operators or payment processors).

6.2. Algarve Sensations complies with the General Data Protection Regulation (GDPR) and Portuguese data protection legislation. For more information, please see our Privacy Policy.

6.3. Cookies are used on the website to improve the user experience. By using the website, you are consenting to the use of cookies, as described in our Privacy Policy.

7. Intellectual Property
7.1. All content on www.algarvesensations.com, including text, images, logos and designs, is the property of Algarve Sensations or its licensors and is protected by copyright and other intellectual property laws.

7.2. Users may not reproduce, distribute or modify any content without the prior written consent of Algarve Sensations.

8. Limitation of Liability
8.1. Algarve Sensations is not responsible for any direct, indirect, incidental or consequential damages arising from the use of the website or participation in tours and experiences, except where prohibited by law.

8.2. Algarve Sensations is not responsible for delays, cancellations or changes due to force majeure, including, but not limited to, weather conditions, natural disasters or governmental actions.

8.3. The website is provided "as is", without warranties of any kind, including accuracy, reliability or fitness for a particular purpose.

9. Applicable Law and Dispute Resolution
9.1. These Terms and Conditions are governed by the laws of Portugal.

9.2. Any disputes arising from these terms or the use of the website or services shall be subject to the exclusive jurisdiction of the courts of Faro, Portugal, unless required by law to the contrary.

10. Amendments
10.1. Algarve Sensations reserves the right to modify these Terms and Conditions at any time. Amendments will take effect upon publication on the website.

10.2. Continued use of the website or services after the changes constitutes acceptance of the updated terms.
